When to use: Buyer scammed you and Vinted refunded them / paid for an item that never arrived / received a counterfeit / wrongly accused of selling counterfeit.

THE LEGAL GROUNDS ON WHICH I DISPUTE THIS
1. UK GDPR Article 22. I have the right not to be subject to a decision based solely on automated processing which produces legal or significant effects. My restriction plainly has such effects. If automated, I have the right to human intervention, to express my view, and to contest the decision.
2. UK GDPR Article 15. I have formally requested all personal data Vinted holds about me, together with the specific reason for the restriction and confirmation of whether automated processing was used. Vinted has one calendar month to respond.
3. Consumer Rights Act 2015, Sections 62 and 68. Terms in a consumer contract must be transparent and expressed in plain and intelligible language. Vinted's Pro Terms of Use, Section 4.2, prohibit selling “a large number of brand new items” — but “a large number” is not defined anywhere. This fails the CRA transparency test and is arguably unenforceable.
4. Consumer Protection from Unfair Trading Regulations 2008, Regulation 5. Pushing sellers into Pro then banning them under vague, undefined terms is arguably a misleading commercial practice.
5. Digital Markets, Competition and Consumers Act 2024. As an online marketplace, Vinted is subject to fair enforcement duties and prohibited from misleading omissions about the protection offered on the platform.
REMEDIES REQUIRED WITHIN 14 DAYS
(a) Immediate reinstatement of my account, or a specific evidenced explanation of the restriction, including the exact rule breached and the evidence relied on.
(b) Immediate release of any funds held in my Vinted Wallet.
(c) Written confirmation of whether the decision was made using automated processing, and, if so, provision for human review under Article 22.
(d) Substantive response to my Article 15 subject access request.
